Terms of Service

1. Acceptance of Terms

By accessing or using the Intiwave website, mobile application, or any of our products and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our Services. These Terms constitute a legally binding agreement between you and Intiwave Inc. ("Intiwave", "we", "us").

2. Eligibility

You must be at least 18 years of age to use our products and services. By using Intiwave, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate information and to update it as needed. You may use an alias or pseudonym — we do not require your legal name.

4. Subscription Services

**Intimate Pass** subscriptions provide access to our premium content library and are billed on a recurring basis (monthly or annually) through the Apple App Store, Google Play, or our website. **Auto-Renewal**: Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. **Cancellation**: You may cancel at any time. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until then. **Price Changes**: We may change subscription pricing with at least 15 days' notice. Price changes will not apply to your current billing period. **EU/EEA/UK Cooling-Off Period**: If you reside in the EU, EEA, UK, or Switzerland, you have a 14-day cooling-off period from the date your subscription begins. You may cancel within this period for a full refund, unless you have already accessed premium content (in which case you acknowledge that you have waived your right of withdrawal by beginning to use the service). **Free Trials**: If offered, free trials automatically convert to paid subscriptions unless cancelled before the trial ends. We will notify you before conversion as required by applicable law. **Refunds**: Except as required by applicable law (including the EU cooling-off period), all subscription purchases are final and non-refundable. For App Store or Google Play purchases, refund requests are handled according to their respective policies.

5. Hardware Products — Purchase Terms

**Pricing**: All prices are displayed in USD and may be subject to applicable taxes, duties, and shipping charges based on your delivery location. **Order Acceptance**: Placing an order constitutes an offer to purchase. We reserve the right to refuse or cancel orders due to pricing errors, product unavailability, or suspected fraud. **Shipping**: We ship to select markets worldwide. Standard shipping (7–10 business days) is free on orders over $50 USD. Express shipping (2–3 business days) is available for $9.99 USD. All orders are shipped in discreet, unmarked packaging. **Risk of Loss**: Risk of loss passes to you upon delivery to the carrier.

6. Warranty Policy

**1-Year Limited Warranty**: All Intiwave hardware products are warranted against defects in materials and workmanship for one (1) year from the date of original purchase. In countries where mandatory warranty periods exceed one year, we extend coverage accordingly. **What Is Covered**: Manufacturing defects that affect the product's intended function. If a valid claim is made during the warranty period, we will replace the defective product free of charge, including shipping. **What Is Not Covered**: (a) Cosmetic deterioration from normal wear and tear; (b) Damage caused by accident, misuse, neglect, or unauthorized modification; (c) Damage from use inconsistent with the product documentation; (d) Opening or disassembling the product. **Claiming Warranty**: Contact support@intiwave.com with your proof of purchase, product serial number, description of the defect, and photos or video evidence. You will receive a Return Merchandise Authorization (RMA) number with return instructions. **Replacement Terms**: Warranty on replacement products is calculated from the original purchase date, not the replacement date. **Extended Quality Guarantee**: If your product develops a fault outside the 1-year warranty period, you are eligible for a 50% discount on a replacement device at intiwave.com. 7. Return & Refund Policy

**Unopened Returns**: We accept returns of unopened, unused products within 30 days of delivery. The product must be in its original, sealed packaging. Contact support@intiwave.com to initiate a return and receive an RMA number. Do not ship returns without prior authorization. **Opened Products**: Due to the intimate and personal nature of our products, we cannot accept returns of opened or used items except under warranty for manufacturing defects. This is standard practice in the intimate wellness industry. **Refund Processing**: Approved refunds are processed within 10 business days of receiving the returned item. Original shipping charges are non-refundable unless the return is due to our error. Return shipping costs are the customer's responsibility. **Damaged or Defective on Arrival**: If your product arrives damaged or defective, contact us within 7 days of delivery with photographs of the damage. We will replace or refund at no cost to you.

8. Product Safety & Compliance

Intiwave products are designed and manufactured in compliance with applicable safety standards including CE (EU), FCC (US), RoHS, and the ISO 3533 standard for product safety. All materials in direct body contact are medical-grade, body-safe silicone — non-porous, hypoallergenic, phthalate-free, and BPA-free. **Not a Medical Device**: Intiwave products are consumer wellness devices. They are not intended to diagnose, treat, cure, or prevent any medical condition. If you experience discomfort, discontinue use immediately and consult a healthcare professional.

9. Content & Intellectual Property

All content available through the Intiwave platform — including audio experiences, software, algorithms, hardware designs, trademarks, and visual assets — is owned by Intiwave Inc. or its licensors and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use content for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, or publicly perform our content.

10. Prohibited Conduct

You agree not to: • Use our Services for any unlawful purpose • Attempt to reverse-engineer, decompile, or extract our software or algorithms • Share your account credentials or allow others to use your account • Redistribute or commercially exploit our content • Interfere with the proper functioning of our Services • Upload malicious code or attempt to compromise our systems • Use our products in any way that could cause harm to yourself or others • Circumvent any access controls, age verification, or digital rights management

11. Dispute Resolution & Arbitration

**Informal Resolution First**: Before initiating formal proceedings, you agree to contact us at legal@intiwave.com and attempt to resolve any dispute informally for at least 30 days. **Binding Arbitration**: Any dispute, controversy, or claim arising out of or relating to these Terms or our Services shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration shall be conducted in English, with the seat in Wilmington, Delaware, USA. The arbitrator's award shall be final and binding. **Class Action Waiver**: You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not as a class, consolidated, or representative action. If this waiver is found unenforceable, the entire arbitration provision shall be void. **Exceptions**: Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for intellectual property disputes or to prevent imminent harm. **EU/EEA Consumers**: If you are a consumer in the EU/EEA, nothing in this section deprives you of mandatory protections under the laws of your country of residence. You may also bring claims before the courts of your country of habitual residence.

12. Limitation of Liability

To the maximum extent permitted by law, Intiwave shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or services, including but not limited to loss of data, loss of revenue, or personal injury resulting from product misuse. Our total aggregate liability shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) $100 USD. Nothing in these Terms excludes or limits our liability for (a) death or personal injury caused by negligence, (b) fraud, or (c) any liability that cannot be excluded under applicable law.

13. Disclaimers

Our products and Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our Services will be uninterrupted, error-free, or free of harmful components.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. For EU/EEA consumers, mandatory consumer protection laws of your country of residence shall apply.

15. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 15 days' notice via email or a prominent notice on our website. Continued use of our Services after the effective date constitutes acceptance of the revised Terms. If you do not agree, you must stop using the Services.
